A 37-year-old Brampton, Ont., man is facing charges under the Highway Traffic Act after an OPP cruiser was sideswiped by a transport truck and an officer suffered minor injuries over the weekend during a traffic stop along Highway 401.

The incident happened around 4 p.m. Saturday on the eastbound lanes of the highway between Highbury Avenue and Veterans Memorial Parkway, Middlesex OPP said in a release.

Police said the officer had pulled over an unlicensed driver on the highway when an eastbound transport truck sideswiped the driver’s side of the cruiser.

The officer was inside the cruiser at the time. They suffered minor injuries and were taken to a nearby hospital by paramedics and have since been released.

The truck involved in the incident pulled over shortly after the incident, and on Monday, police announced the driver had been charged with careless operation of a motor vehicle and fail to move over for stopped emergency vehicle.

“When approaching any emergency vehicle or tow truck that is stopped with emergency lights activated, motorists are required to reduce their speed, use caution and move over leaving at least one lane between their vehicle and the parked emergency vehicle or tow truck,” police said in a statement.

Penalties and fines for violating the move over law, last updated in 2015 to include stopped tow trucks, range from $400 to $2,000 and three demerit points upon a first conviction, with subsequent convictions seeing fines of $1,000 to $4,000, licence suspension, and possible jail time up to six months.
