KELOWNA — The sentencing hearing for David Bobbitt, a Penticton man charged with a brutal sexual assault on a 22-year-old Penticton woman, is scheduled to end Friday.

The crown is asking for Bobbitt to be declared a dangerous offender, which would mean he would be jailed indefinitely.

The statement of facts say that on the morning of July 30, 2011 the woman went to David Bobbitt’s second hand store in Penticton looking for a bed. She left but indicated that she would come back.

When she returned, Bobbitt struck her in the head from behind shortly after entering the store, with what she believed to be a hammer.

The woman dropped the child and fell to the ground. Bobbitt began slamming her head on the concrete floor, saying “Why won’t you die?”, also yelling “Do you remember me now?”

Bobbitt then dragged the woman to the back of the store, where he tied her to a bed and told her he was going to kill her. He sexually assaulted her for at least two hours, her child there the entire time.

He also said he was going to kill the woman in the morning so she wouldn’t tell the cops.

In the morning, Bobbitt seemed to have a change of heart, telling her that he needed to get her to a hospital. But before he could, the woman’s brother appeared outside the store, banging on the front door.

Bobbitt fled the store and the police arrived. They found the woman partly tied-up and the child wearing a blood soaked t-shirt – though the woman told police that Bobbitt did not touch the child.

A few days later Bobbitt was arrested near Oliver.

The crown is asking for Bobbitt to be locked up indefinitely, while the defence is seeking a prison term between 10 to 14 years, with another 10 years supervision. Bobbitt is expected to say something to the court Friday before he’s sentenced.
