Cape Breton man charged in fisherman’s murder to seek bail again

PORT HAWKESBURY, N.S. – A 43-year-old Cape Breton man charged with second-degree murder is once again expected to make a bid for bail Tuesday.

Dwayne Matthew Samson of D’Escousse is one of four people charged in connection with the June 1 death of 43-year-old Phillip Joseph Boudreau in the waters of Petit-de-Grat harbour.

Samson was previously denied bail on July 29 but his defence lawyer Nash Brogan served notice that his client is again making an application for interim judicial release.

The hearing is scheduled for court in Port Hawkesbury.

The judge’s reasons for initially denying bail are banned from publication until a final disposition in the Samson case.

Boudreau’s overturned boat was found and despite extensive ground and water searches, his body was never discovered.
