SIOUX LOOKOUT, Ont. – A 26-year-old man whose four-year stint in solitary confinement sparked a public debate on the practice in Ontario jails has been arrested in connection with an alleged sexual assault.
Ontario Provincial Police say Adam Capay is charged with one count of sexual assault with a weapon in relation to the alleged incident on March 6.
Police did not provide any details about the alleged incident in Kejick Bay, Ont., but say the investigation is ongoing.
In January, an Ontario judge stayed a murder charge against Capay after he spent four years in solitary confinement in two northern Ontario correctional facilities.
The judge said Capay, who was accused of killing a fellow inmate, had endured permanent memory loss and saw his mental health deteriorate significantly because of his time in segregation and was therefore unable to stand trial.
Capay’s situation, which involved spending months at a stretch in Plexiglas cells with the lights on 24 hours a day, prompted the government to put a cap on the length of time a person can be held in segregation.
