WATCH: Three months in jail for killing Kelowna motorcyclist

KELOWNA — A Kelowna man whose distracted driving caused a fatal crash today pleaded guilty to driving without due care and attention.

In march 2012, mark Sameer Batraki, 38, drove his jeep into a motorcycle stopped at a red light on Harvey Avenue.

The driver of the bike,  Jules Kreeft, was killed and his wife and passenger was badly injured.

At first, Batraki said he was looking down into his lap when the crash happened.

Now he says he was doing shoulder checks for a lane change.

The judge handed Batraki a three month jail sentence,  a $1500 fine, and a five year driving prohibition.

Those penalties are more severe than what the prosecutor was seeking.

Kreeft’s son thinks Batraki should have faced charges under the criminal code rather than the motor vehicle act.
