Stanley Cup rioter receives no jail time

The first accused Stanley Cup rioter to fight his charges in court will not go to jail. 26-year-old Spencer Kirkwood has received a 30-day conditional sentence.

In April, Kirkwood was found guilty of mischief and participating in a riot, as well as for breaching a court order to avoid alcohol.

Kirkwood’s lawyer claimed his client was too drunk to recall his actions that night, but the judge disagreed, saying he was aware of what he was doing and was even enjoying the attention from onlookers.

Crown was asking for 30 to 40 days days, 100 to 150 hours of probation, and community service for participating in the riot.

Kirkwood’s lawyer asked for no jail time, saying his client is one of the most remorseful of the accused rioters.
