ELLIOT LAKE, Ont. – The inquiry into a fatal northern Ontario mall collapse is to hear today from a structural engineer involved with the building of the Algo Centre Mall.
The engineer apparently lost his licence over problems with several other building projects.
Meanwhile, The Canadian Press has learned that the commission probing the collapse of the Elliot Lake mall’s roof-top garage is poised to take the owner to court in a fight over documents.
At issue is the inquiry’s efforts to obtain thousands of documents related to the Algo Centre Mall from Bob Nazarian, his wife and son.
Commissioner Paul Belanger has already formally ordered Nazarian to comply with several summonses to turn over the material, which one of Nazarian’s lawyers says they are working to gather.
Sources familiar with the situation say the commission is fed up with delays and would be looking to Ontario’s Divisional Court to force compliance.
Nazarian is a key figure in light of allegations that he failed to carry out proper maintenance, which might have averted last June’s tragedy that killed two women.
Nazarian has strenuously denied those allegations.
