CALGARY – A proposed class action lawsuit has been filed against Air Canada after a “computer error” caused flights to be advertised at 10 per cent of their actual price last week. Customers allege the passes they bought were then removed from their accounts before they were able to book trips.
B.C. law firm Munroe & Company alleges the airline broke consumer protection laws. The firm filed the suits in the Superior Court of Quebec and a similar class action in the Supreme Court of British Columbia.
“Air Canada sold discounted flight passes to consumers and subsequently repossessed the flight passes,” said the firm in its summary of action. “After repossessing the flight passes, Air Canada deleted information from its website and misrepresented its contractual rights to consumers.”
The suit seeks compensation for affected customers for the loss of the flight passes, as well as “compensatory and punitive damages for misleading customers.”
Air Canada advertised a 10-credit flight pass for $800 on Aug. 25 (meaning 10 one-way flights). Many people jumped on what they thought was a deal and bought the pass. When they tried to book flights, the clients said they were unable to do so.
One customer sent in a screenshot showing Air Canada’s claim that “the price of the Flight Pass is guaranteed. You will pay nothing more if the price of the Flight Pass changes after you purchase it.” He said that FAQ section was later removed.
Air Canada spokesperson Peter Fitzpatrick said in a previous statement a “computer loading error resulted in a temporary mispricing of a West Coast flight pass product for Business Class travel” on Aug. 25.
As of Tuesday, Fitzpatrick didn’t have numbers on how many people were able to book with the passes, if any, but said “any trips booked using the passes will be honoured.” He had no comment on the proposed law suit.
