Calgary nurse not guilty in sex assault of 13-year-old patient

CALGARY – Calgary nurse Drew Legary was found not guilty of sexual assault and sexual interference Wednesday.  The charges stemmed from an incident in 2011 with a then-13-year-old boy at the Alberta Children’s Hospital.

The Crown had told court Legary intentionally touched the young teen in a sexual manner. The defence maintained Legary was giving the child a physical exam that included the groin area, and any touching of the child was accidental or incidental.

The judge ruled Wednesday she did not believe the touching was for a sexual purpose and said it was quite possibly accidental.
