‘I did not assault that child’ says Calgary nurse accused of sex assault

CALGARY – A Calgary nurse is testifying in his own defence Tuesday morning.

Drew Legary is accused of sexual assault and sexual interference against a 13-year old-boy who was a patient at the Alberta Children’s Hospital in 2011.

Forty-six-year old Legary told court:  “I did not deliberately or intentionally touch his penis…I did not assault that child.”

Legary’s account contradicts the victim’s testimony given Monday, who said Legary fondled him and made sexual comments to him.

Legary told court he walked in on the boy masturbating, and since it was an uncomfortable situation, he tried to talk to the boy about it so he wouldn’t be embarrassed.

He said he did examine the boy’s groin area to see if his lymph nodes showed signs of inflammation, but Legary denied touching his genitals.

Legary was a nurse at the hospital for more than four years.

The alleged abuse happened in Sept. 2011; Legary has been suspended without pay ever since.
