Tobacconist guilty of displaying cigarettes: NS gov

KENTVILLE, N.S. – The Nova Scotia government says it has won its case against a tobacco shop owner who challenged a provincial law that bans stores from advertising tobacco products behind store counters.

Bob Gee, who runs Mader’s Tobacco Store Ltd. in Kentville, challenged the Tobacco Access Act on the grounds that it violated his right to freedom of expression.

In August 2010, the provincial court in Kentville ruled in favour of Gee’s argument.

That placed the onus on the province to prove the infringement of those rights was reasonable and for the public good.

The province says the court has accepted its argument that the law is necessary for the public good.

Health Minister David Wilson says he is pleased with the court’s decision.
