Banff Constructors Ltd. has pleaded not guilty to two charges in relation to a 2016 workplace death at the construction site of the new Children’s Hospital of Saskatchewan in Saskatoon.
Eric Ndayishimiye, 21, who had been on the job for just under six months, died on July 21, 2016, after a steel construction lift fell on him.
Banff Constructors Ltd. was charged with failing to make arrangements for the use, handling, and transport of trolleys in a manner that protects the health and safety of workers. They are also charged with failing to provide any necessary information, instruction, training and supervision resulting in the death of a worker.

The other company charged in relation to Ndayishimiye’s death, Pilosio Canada Inc., also appeared in Saskatoon provincial court via telephone Tuesday morning.

Pilosio is charged under Saskatchewan’s Employment Act with failing to ensure equipment supplied to any owner, contractor, employer or worker is safe when used in accordance with the instructions provided by the supplier, resulting in the death of a worker.
A plea wasn’t entered on Tuesday, as the company hopes to present further evidence to investigators in July.
The case is due back in court on August 31 for case management.
