Crown Counsel says they are applying to have BC child-killer Allen Schoenborn designated a ‘high-risk accused.’
Schoenborn was previously found ‘not criminally responsible’ for killing his three children in Merritt in 2008. He’s been staying at the forensic psychiatric hospital in Coquitlam, but has been allowed out on daypasses.
What does “high-risk accused” mean?
The designation would mean the period of time between reviews on his freedom could be extended by up to 36 months. It doesn’t mean he’s never allowed to leave the hospital, but only for medical reasons.
The hearing is September 10th.
Bill C-14 Amendment to Criminal Code
The “high-risk” application is based on the new amendment to the Criminal Code “to enable a finding of “high-risk accused” for adult persons who have been found NCR for a prescribed serious personal injury offence.”
For the application to success, the Crown must establish either:
- that there is a substantial likelihood an accused will use violence that could endanger the life or safety of another person; or,
- that the offences the accused committed were of such a brutal nature, they indicate a risk of grave physical or psychological harm to others (section 672.64(1) Criminal Code).
It’s the news the family of Allan Schoenborn’s victims has been waiting for.
“The family’s absolutely ecstatic.”
Some good news for a family that’s had to endure yearly hearings with the BC Review Board.
“It’s clearly been working for about five years now – and to have the Crown support that – it’s a very, very happy family.”
Family spokesperson Dave Teixeira says its a stark difference from the day passes the Review Board approved earlier this year.
“The Review Board does not have the interest of victims. They are there just for the accused.”
Teixeira says the application will be made on September 10th at 2:00 pm.
BC’s Attorney General issues a statement regarding the application:
Attorney General Suzanne Anton says the family of Schoenborn’s victims have her support.
In a statement to CKNW, Anton says the victims have her sympathy, as well as that of all British Columbians, adding she can’t imagine what an ordeal this has been for them over the years.
Anton is assuring BC that the province is concerned with protecting the safety of communities.
