MANCHESTER, N.H. (AP) — A Massachusetts State Police trooper has been indicted in New Hampshire on charges that he beat a suspect in Nashua earlier this year.

Thirty-two-year-old Joseph Flynn was indicted on charges of simple assault by an on-duty law enforcement officer for his role in the May 11 arrest of Richard Simone Jr.

Court documents allege that Flynn punched the back and right side of Simone while the Massachusetts man was kneeling on the ground to surrender following a chase.

The roughly 50-mile chase began in Holden, Massachusetts, after Simone refused to stop for police. He had multiple arrests warrants pending at the time.

New Hampshire State Police Trooper Andrew Monaco pleaded guilty in August to simple assault charges stemming from the incident

Flynn’s attorney indicated his client will fight the charges.
