Whole Foods says it will seek action against the Texas pastor and his attorneys who claim the company sold him a cake with a homophobic slur on it.
“After a deeper investigation of (Jordan) Brown’s claim, we believe his accusations are fraudulent and we intend to take legal action against both Mr. Brown and his attorney,” the company said in a statement Tuesday.
Brown, the openly gay founder and lead pastor of the Church of Open Doors announced Monday that he was suing the company over a cake he purchased at the chain’s flagship store Saturday. Brown said a store clerk decorated the cake with the words ‘Love Wins F–’.

Brown and his lawyers also released a video on YouTube Monday in which he shows the cake and claims the desert to be in its original packaging.

Whole Foods says they are investigated the incident, and that the packaging was tampered with once it left the store.
“Mr. Brown admits that he was in sole possession and control of the cake until he posted his video, which showed the UPC label on the bottom and side of the box,” the statement reads.
“After reviewing our security footage of Mr. Brown, it’s clear that the UPC label was in fact on top of the cake box, not on the side of the package. This is evident as the cashier scans the UPC code on top of the box.”
The company released security footage of Brown purchasing the cake to back its claims.
