An openly gay pastor in Austin, Texas has filed a lawsuit against Whole Foods claiming he was sold a cake with a homophobic slur written on top.

Jordan Brown, the founder and lead pastor of the Church of Open Doors, says he ordered a cake Saturday at the company’s flagship store in Austin, with the words, ‘Love Wins’ to be added later in frosting.

The suit alleges an employee took the cake back to add the lettering, handed Brown back the cake sealed in a box and he went on his way.

Brown says he drove off and when he sneaked a peak at the cake at a stoplight, he saw the offensive message which read ‘Love Wins F–’.

The pastor says he called the chain but was unable to receive a response. He then called the store and spoke with a team leader who told him he would fire whoever was responsible and also provided Brown with a replacement cake and a gift card.

The lawsuit alleges the employee called back two hours later and said, “Whole Foods came to the conclusion the store and the bakery associate had done nothing wrong.”

Whole Foods released a statement on Monday which says “Our team member wrote “Love Wins” at the top of the cake as requested by the guest, and that’s exactly how the cake was packaged and sold at the store.”

The statement also read, “We stand behind our bakery team member, who is part of the LGBTQ community, and the additional team members from the store, who confirmed the cake was decorated with only the message ‘Love Wins.’”
