Nick (Nicholas) Chan is charged with the first-degree murder of Sanjeev Mann.

In his opening statement to the jury Monday, prosecutor Adam May said the Crown doesn’t believe Chan shot Mann–or anyone else–at the Bolsa restaurant, but the Crown believes Chan was a “leader” of the gang (FOB) responsible, and “encouraged” a fellow gang member to kill Mann.

It was believed Mann had killed Roger Chin, a member of the FOB gang in July 2008, and that this would have been retaliation for that killing.

Mann, Aaron Bendle and innocent bystander Keni S’ua were all killed in the shooting at the Bolsa Restaurant on New Year’s Day 2009.

The Crown alleges Chan helped plan the murder, and encouraged a fellow gang member to kill Mann.
