Judge refuses Dorval golf course soil sampling injunction

DORVAL – A judge has rejected a request by Dorval residents to stop soil sampling at the Dorval Municipal Golf Course, said advocates for the course.

The failed temporary injunction comes after Aéroports de Montreal (ADM) ended its lease with the golf course to build a new security screening section for airport workers and other non-travellers.

“The ADM and Transport Canada lawyers were adamant that they have the right to do what they wish on federal land without heeding provincial or local laws,” reads a letter distributed to a residents’ coalition.

“The judge, in his ruling, just addressed the issue of permanent damage to the course that, in his opinion, could be repaired and consequently refused our request for a temporary injunction.”

The group said it is not planning to give up the fight just yet.

It is pushing for a permanent injunction and it said a court date has been set for Feb. 5.

“I believe that the recourses we have, while limited, are still there,” Bruce Orr, coalition co-chair, said in the letter.

“We have tried several times to meet with our local member of parliament and even the Minister of Transport to no avail,” the letter continues.

According to the ADM, soil sample tests are expected to be finished by Dec. 23.
