Crown prosecutors will now be able to go forward and argue that child killer Allan Schoenborn should be labelled a high-risk offender.
A spokesperson for the victim’s family said Schoenborn has failed his constitutional challenge of C-14.
Schoenborn was found not criminally responsible for killing his three children in Merritt in 2008.

The Crown is trying to get him designated a high-risk offender, which is a label that was only created last year.
The province wants the law to apply retroactively, which would mean Schoenborn would be locked up indefinitely.
“What we understand is, he’s actually not yet had any privileges into the community because he continues to have violent outbursts,” said Dave Teixeira, the family spokesperson.
