Mitchell Harkes appeals murder conviction for stabbing death of U of C student

CALGARY – A man convicted last month of killing a University of Calgary student filed an appeal Monday.

Mitchell Harkes, 22, was sentenced Oct. 3 to life in prison with no chance of parole for 12 years.

Brett Wiese, 20, died after being stabbed in the back outside a Brentwood home in the early morning hours of Jan. 12, 2013. Another man was also stabbed several times but recovered.

Harkes was found guilty on all charges, including second-degree murder, attempted murder and aggravated assault.

An appeal was filed on behalf of Harkes on Monday for both the second-degree murder conviction and the sentence of life with no chance of parole for 12 years.

The appeal cites several reasons including:

  • Verdict unreasonable/cannot be supported by evidence;
  • Judge erred by allowing prosecutor to cross examine Harkes on prior criminal record;
  • Judge erred by allowing jury to determine guilt based on joint enterprise.
