OTTAWA – The fraud trial of Mike Duffy resumes today after taking a break of several weeks.

It’s expected Duffy’s lawyer Donald Bayne will present arguments that the Senate should hand over the results of a 2013 audit examining the residency status of all senators.

The Senate has refused to release the internal residency audit, citing parliamentary privilege – a form of immunity that exempts lawmakers from certain aspects of the justice system.

Arguments are expected to last most of today, then the Crown will resume calling its witnesses.

Duffy has pleaded not guilty to 31 counts of fraud, breach of trust and bribery, some of which are related to the living and travel expenses the PEI senator filed after declaring a secondary residence in the Ottawa-area.

Duffy is under suspension from the Senate.
