SASKATOON – The father of a toddler who died while in foster care says he is planning on suing social services. Evander Daniels drowned in a bathtub of scalding water in 2010.

Daniels, who was 22-months-old, was living in an overcrowded foster home when it happened.

A coroner determined it was an accidental drowning. The foster mother was found not guilty of criminal negligence causing death.

Daniels was the fifth child placed in the home that was approved to care for three children.

His father, Chris Martell, said Thursday he plans to file a lawsuit.

Martell’s lawyer says the case will focus on the boy’s death, systemic discrimination and a failed system.

None of the allegations have been proven in court.

In a report released on May 20, Saskatchewan’s children’s advocate found there are persistent problems in foster care that haven’t been addressed despite efforts by social services.

Among his findings, Bob Pringle said there was a lack of quality case management and supervision, and renewed calls for foster homes to be licensed.
