Tomassi was charged with two counts of criminal fraud and one count of breach of trust. He has yet to make a public statement about the charges and whether he will resign his seat.

He has been sitting as independent since the Liberals kicked him out of caucus in May 2010. He was booted after it was revealed Tomassi had used a credit card owned by a security company that had received government contracts.
