WATCH: Oliver man sentenced for killing his brother

PENTICTON — The man responsible for killing his younger brother will have to spend six more months in prison, but has a long road of rehabilitation ahead of him. B.C. Supreme Court Associate Chief Justice Austin Cullen handed down the manslaughter sentence to Kyle Louie at the Penticton court house Thursday morning  in front of Louie’s family and supporters. Cullen has accepted Crown Counsel and Defense’s joint submission of a 75-month jail sentence and a 5.5-year long-term designation, which means he will be under greater scrutiny than if he were just on probation. Kyle will only have to serve six months because of enhanced credit earned from time already served.

“Kyle is relieved and I think he wants to move forward in a positive way,” says defense lawyer Tom Arbogast.

The court heard how alcohol, drugs and sleep deprivation played a significant role in how the events unfolded on February 19, 2011.

Kyle was arguing with his younger brother Reece Louie, who was 21-years-old at the time, over a $30 debt.

Reece was stabbed multiple times, and he eventually died in hospital of blood loss.

“What is at the heart of this tragic and troubling case is that [Kyle’s] actions resulted in the senseless death of his best friend,” says Cullen to the court room. “Therefore, he is the perpetrator and the victim of the actions he perpetrated.”

After Kyle’s jail sentence, a 5.5-year long-term designation will follow. What will be included in that designation will be set out and supervised by the National Parole Board.

The judge recommends that Kyle be sent to residential facilities where he can receive treatment, followed by half-way houses before being integrated into the community.

The court heard how Kyle has aspirations of becoming a mechanic, and this designation will help him achieve his goal.

“He’s still a very young man and we hope he has a very bright future ahead of him,” says Crown Counsel John Swanson.
