No charges in case of 12-year-old killed in crash with child driver

VANCOUVER – Friends and family of a 12-year-old girl who died in an unusual car crash are upset a man accused of letting a 11-year-old drive, won’t face criminal charges.

The victim, Sheraya Quam, was camping with a friend on the May long weekend last year. Police say she was a passenger in a Jeep being driven by a 11-year-old.

A 41-year-old man was in the back seat at the time.

The young driver lost control of the vehicle and it flipped over.

Sheraya died at the scene and now the family has been told the man will never be brought to court.

“Even conduct that may include some degree of negligence or irresponsibility will not necessarily reach the level of criminal negligence,” said Neil MacKenzie, communications counsel for the BC Criminal Justice Branch.

“In this case the Crown concluded the available evidence did not provide a substantial likelihood of conviction for a criminal negligence charge.”

Sheraya’s mother said she is very angry and Crown and B.C.’s justice system.

“It’s just been really hard without her,” said Sherri. “I miss her. It’s hard to function on a daily basis without her.”
