No appeal in Katherine Quinn acquittal

The Crown will not appeal the acquittal of Katherine Quinn, 27, accused of second-degree murder in the death of Surrey teen Matthew Martins.

“[Justice Wendy Baker] was meticulous in coming to her judgment,” said Robin Baird of the Criminal Justice Branch. “We’ve decided that there’s no error that we can take an appeal on.”

In 2005, 16-year-old Martins and Quinn struggled in front of her Whalley home over Martins’ necklace. Martins stabbed her with a small knife.

Quinn’s friends chased the teen to a SkyTrain station, where her boyfriend, Robert Forslund, 28, beat him to death, allegedly encouraged by Quinn.

Forslund and Quinn were convicted of first-degree murder in 2007, but Quinn’s conviction was overturned.

A new trial was ordered. Justice Baker said there were discrepancies in the witnesses’ testimony.

Martins’ father, David Toner, said Wednesday that though “they couldn’t prove that [Quinn was] guilty. . . that doesn’t mean she’s innocent.”
