Mother accused in death of infant son won’t stand trial

CALGARY- A young Calgary woman accused in the death of her infant son will not have to stand trial.

22-year-old Shelby Anna Herchak’s 26 day-old-son was rushed to hospital back in August 2010, where he died the same day. An autopsy found he died of blunt-force trauma to the head, and Herchak was charged with second-degree murder.

She was originally scheduled to stand trial next week, but on Thursday court heard that there is now a deal in the works between the defence and Crown.

They’re not saying exactly what the resolution will be, just that a trial won’t be necessary.

“What I’m anticipating happening is a plea will be entered, and between now and then the Crown and I will work out an agreed statement of facts,” explains defence lawyer Kim Ross. “Hopefully the matter will be completely resolved.”

Herchak is currently in custody, after having her bail revoked for allegedly breaching her conditions.
