Judge reserves decision, in case of cancer-stricken woman accused in daughter’s death

CALGARY- A judge will decide later this month if a Calgary woman convicted in the death of her daughter should have to face a new trial.

Aset Magomadova was convicted of manslaughter in the strangling death of her 14-year-old daughter Aminat back in 2007. But after the Crown appealed, court ordered a new trial on second-degree murder charges.

Magamadova does not want a new trial, as she has terminal cervical cancer, and her lawyer argues she is confused because of the medication she’s on. However, prosecutors argue there is no evidence a new trial would have any impact on her health.

Two news reporters also testified on Wednesday, who happened to see Magomadova on a scooter in Kensington last June, and took photos of her.

The Crown said that shows Magomadova is not as bed-ridden as some might think. The defence countered by saying that on six occasions when police had her under surveillance, Magomadova did not leave her home.

The judge is set to hand down a ruling later this month.
