CALGARY – The mother charged with second degree murder in the death of her 26-day-old baby has been granted bail.
Following a hearing Wednesday afternoon, a Queen’s Bench Justice granted Shelby Anna Herchak release.
On August 9th, paramedics rushed Shelby’s son Daniel to the Alberta Children’s Hospital from the family’s home in southwest Calgary. Medical staff called police when the baby’s injuries appeared suspicious. The boy later died.
An autopsy determined the cause of death was blunt force trauma to the head.
18-year-old Shelby was arrested in August 24th and has been held in custody until today.
“This is a case where we have a situation that in my respectful submission there’s absolutely no risk to the community with my client being released at this time,” says Kim Ross, Herchak’s lawyer.
Herchak must follow a number of conditions, including she must live with a relative and be closely monitored in the community and avoid using any social networking websites.
She is scheduled to appear in court again next week.
