Manitoba Hydro is going the Manitoba Court of Appeal in hopes of overturning an order from the Public Utilities Board to create special rates for residential customers on First Nations.
The Crown corporation filed the appeal Friday, saying that the PUB overstepped its jurisdictional boundaries, questioning whether it’s allowed to create special rates on social policy merits.

“We believe that the PUB exceeded its jurisdictional authority by ordering the creation of a special rate class which contravenes Manitoba Hydro’s legislative requirement to maintain uniform rates for all residential customers, regardless of where they reside in Manitoba,” said Kelvin Shepherd, President of Manitoba Hydro.
Hydro also wants a review of the PUB’s directive to hire a consultant to assess the implementation of various asset management initiatives.
“This aspect of the PUB order is not consistent with governance structure and authority established by legislation.”
