The Antigonish resident was scheduled to elect the mode of his trial today, but it was put off until the new year.

Fogarty’s lawyer is leaving legal aid so a new legal-aid lawyer from Halifax has been assigned to take over the case, which is scheduled to return to court Feb. 2.

Fogarty was the lone survivor of the two-vehicle crash in late November.

Two Antigonish County teens in the other car died in the collision.
