Many used items on sale for cheap at local yard sales – May 29, 2016

REGINA – Garage sales are a great way to buy used items for less such as Tupperware and dishes, to lawn mowers and ellipticals.

Often, yard sale junkies show up rain or shine, and love to bargain.

But buyer beware, as not all items are suitable for re-sale. As a seller, you are legally responsible for all items sold. You can even be liable under the Consumer Product Safety Act.

According to Health Canada there are several items that are illegal to sell or giveaway including jequirity beans, lawn darts with elongated tips, baby walkers, infant self-feeding devices, and polycarbonate baby bottles captaining BPA.

Items that are regulated under the Canada Consumer Product Safety Act, the Food and Drugs Act, and or have cosmetic regulations include some of the following:

– Car seats must have a national safety mark on them and meet all regulatory requirements according to Transport Canada.

– Cribs manufactured before 1986 most likely do not meet current safety requirements. Any cribs ten years or older are not recommended for re-sale due to missing warnings and instructions or in case the item is broken, damaged or loose.

– Strollers and carriages made before 1985 are recommended to not be resold.

– Baby gates that have a diamond shaped opening or “V” at the top larger than 38mm are illegal in Canada.

– Cosmetics which are used, old or damaged should never be sold.

– It is illegal to sell garden torches without required labeling or packaging.

– All jewelry needs to be lead free.

– Ice hockey helmets and face protectors must carry a sticker indicating they meet safety standards set by the Canadian Standard Association (CSA). The standard number needs to be clearly visible on the helmet.
