SASKATOON – The family of a woman who died after she was struck by a school bus on the side of a Saskatchewan highway last February has filed a lawsuit against the driver and two school boards.

The crash happened on Feb. 3 when the northbound bus hit a broken down truck hauling a cattle trailer parked on the side of Highway 4 north of Biggar.

Monica Domes, 40, who was standing by the truck, was critically injured and pronounced dead in hospital a short time later.

The lawsuit claims the driver of the bus, Edward Cumpstone, was “negligent in the performance of his duties as a school bus driver.”

It also claims both the Saskatoon Catholic and Sun West School Divisions, who employed Cumpstone, failed to “carefully and prudently train, supervise, and monitor their employees … in the performance of their duties as a school bus driver.”

None of the claims have been proven in court.

Domes’ family say they have suffered physiological and emotional distress since the crash, including the couple’s twin boys who were passengers on the bus.

Cumpstone pleaded guilty last month to driving without due care and attention and was fined $500 along with an $80 surcharge.
