Attempt by Whitby councillor to exclude temporary foreign workers ruled ‘discriminatory’

March 13, 2026
A law firm has decided a motion from Whitby Councillor Chris Leahy directing town staff to look at prohibiting awarding contracts to companies participating in the federal Temporary Foreign Worker Program is "discriminatory." Lerners LLP says such a bylaw amendment would "almost certainly be successfully challenged in the courts and struck down, exposing the Town to significant costs and reputational harm." The law firm finds the motion contravenes the Ontario Human Rights Code, which prevents discrimination based on citizenship, as well as Charter protection for temporary foreign workers. Leahy attempted to move the motion at a council meeting in February, but it was ruled out of order by Mayor Elizabeth Roy. He says he was aiming to address increasing unemployment.
