The panel heard that Moshenko, Bear and a third man, Cody Walker, had been drinking and left the Muskoday First Nation in a truck but got stuck on a rutted road.

They got out but for some reason, Walker hit Bear with his fist and Moshenko joined in before the victim was eventually beaten to death.

A sentencing hearing will take place Oct. 16, while Walker has previously pleaded guilty to manslaughter.
