Sentencing for daycare operator after baby died in her care

Crown is asking for two to three years in jail for a woman who is charged with manslaughter, failing to provide the necessaries of life and obstruction of justice after a baby died in her care in January 2011.

Maria McFerran operated the Rattle-N-Roll Daycare in her Shaughnessy Street home and had one-year-old Arto Howley in a car seat.

McFerran was only supposed to have two children in her care at one time, but actually had a total of seven.

Court heard that before calling 911 she hid the car seat in the garage and tried to wake Arto. She told police he was in a playpen and choked on a blanket.

It was Arto’s first day at the daycare.

The defence is asking for six to 12 months in jail.
