A 14-year-old Henrico County, Va. student could face assault and battery with a weapon charges after throwing a soft baby carrot at a former teacher.
Aliya May told WTVR News she jokingly tossed the vegetable towards the teacher in the hallway, not thinking it would hit the school educator in the face.
May has been suspended from school for a month and her mom, Karrie, is frustrated by the whole situation.
“I don’t even know how to combat the stupidity of it,” Karrie told WTVR. “We got court, she’s charged. Not small charges: assault and battery with a weapon.”
A legal expert for CBS said the definition of battery is in line with the assault charges the teacher is accusing May of.
“…You don’t have to have an injury for a battery, there doesn’t have to be a showing that somebody was hurt, it just has to be an offensive – an unwanted touching. That’s what the law says,” Todd Stone, a legal expert, told WTVR.
But Stone doesn’t think May will be charged with anything.
Karrie said her daughter’s school’s disciplinary review board sent a letter to the family asking May to admit her guilt, but they declined.
“She was playing,” Karrie told WTVR.
May is now awaiting a summon for next steps in the case.
