THE MORNING SHOW (“TMS”)
“TECH FREE EUROPEAN TOUR AUDITION” (THE “AUDITION”) GUIDELINES
(THE “AUDITION GUIDELINES”)
Become a tech-free travel correspondent. Submit your Audition Video (as defined below) for a chance to travel to Europe and be featured on The Morning Show!
SUBMISSION OF AN AUDITION VIDEO IN CONNECTION WITH THE AUDITION CONSTITUTES ACCEPTANCE OF THE FOLLOWING AUDITION GUIDELINES.
- ELIGIBILITY TO AUDITION.
(a) To be eligible to audition to be a travel correspondent (“Travel Correspondent”) for TMS, you must:
(i) be a legal resident of Canada (excluding the province of Quebec);
(ii) be between the ages of twenty (20) and twenty-five (25);
(iii) have a valid YouTube or Vimeo account;
(iv) have an active account on Twitter and/or Instagram at the time you submit your Audition Video;
(v) if selected as a Travel Correspondent, be able to travel and participate in a Contiki “Best of Europe” trip beginning in Paris, France and ending in Rome, Italy for approximately two (2) weeks between July 25, 2014 and August 15, 2014 (exact dates to be determined) (the “Trip”);
(vi) in addition, if selected as a Travel Correspondent, be able to travel to and participate in a minimum of three (3) on-camera or in-studio interviews on dates and times to be determined by TMS in its sole discretion (the “Interviews”); and
(vii) be the sole owner of all right, title and interest (including copyright) in and to the Audition Video submitted by you in connection with the Audition.
(b) Employees of Shaw Television Limited Partnership (“Shaw”), Contiki Holidays Canada Ltd (“Contiki”) and each of their respective affiliates, subsidiaries, related companies, advertising and promotional agencies and the household members of any of the above, are not eligible to participate in the Audition.
(c) TMS shall have the right at any time to require proof of identity and/or eligibility to participate in the Audition. Failure to provide such proof may result in disqualification.
(d) TMS reserves the right, inits sole discretion, to disqualify you, if you:
(i) are unable to meet any of the above noted eligibility criteria;
(ii) at any stage, supply untruthful, incomplete, inaccurate or misleading personal details and/or information;
(iii) breach the terms of these Audition Guidelines in any way;
(iv) tamper or attempt to tamper with the Audition or the operation of the Audition website, available at www.morningshow.ca/techfreetour (the“Audition Website”);
(v) act in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; and/or
(vi) submit an Audition Video that refers, depicts or in any way reflects negatively upon Shaw, TMS, Contiki, this Audition or any other person or entity.
(e) If TMS disqualifies you for any of the above noted reasons, TMS’s decision may not be appealed or challenged in any way.
(f) TMS will not consider Audition Videos if they are illegible, incomplete, damaged, irregular, mutilated, forged, plagiarized or garbled.
(g) No communication or correspondence will be exchanged with you unless you are selected as a Travel Correspondent.
- HOW TO SUBMIT AN AUDITION VIDEO.
(a) Audition Videos may be submitted from 9:00 a.m. Eastern Daylight Time (“EDT”) on Tuesday, June 10, 2014 until 12:00 p.m. EDTon Friday, June 20, 2014, after which time no further Audition Videos will be accepted.
(b) Send an email to techfreetour@themorningshow.ca and be sure to include your name, phone number, address and date of birth, along with your Twitter handle and/or Instagram account name and the YouTube or Vimeo link to your Audition Video submission (the “Audition Video”). Your Audition Video must be between thirty seconds (0:30s) and sixty seconds (0:60s) in length. In your Audition Video, tell us why you think you would be the perfect candidate to go tech free for almost two (2) weeks. Make sure the lighting and sound are working and have fun!
(c) You may only submit one (1) Audition Video. If you submit multiple Audition Videos, only the first Audition Video submitted will be considered.
(d) You represent and warrant that your Audition Video: (i) is of yourself; (ii) does not contain any material, language or gestures that are libelous, defamatory, indecent, profane, obscene or violent; (iii) does not contain any sexual references and/or content; (iv) is original and that you own or control, to the full extent necessary for Shaw to use your Audition Video, all right, title, and interest (including copyright) in your Audition Video; (v) does not infringe upon the intellectual property or other statutory or common law rights of any third party; (vi) does not contain any recognizable logos or any other copyrighted material (including on the clothing you are wearing in your Audition Video); (vii) does not contain any mention, endorsement, or “plug” any commercial product, service, venture or thing, including, without limitation, the name of your employer; and (viii) has not been submitted in connection with any other audition and/or promotional campaign.
- TRAVEL CORRESPONDENT SELECTION
(a) On Monday June 23, 2014, after reviewing all eligible Audition Videos received, TMS will select two (2) potential Travel Correspondents pursuant to the following terms and conditions:
(i) the potential Travel Correspondents will be selected based on their personality, on-camera presence demonstrated in their Audition Video, their reasons for why they think they would be the perfect candidate to go tech free for almost two (2) weeks and their presence on social media as demonstrated in their Twitter and/or Instagram account. TMS’s decisions regarding the selection of the potential Travel Correspondents are final and may not be challenged in any way.
(ii) the potential Travel Correspondents shall be notified byTuesday, June 24, 2014 at 12:00 p.m. EDT of their selection as a potential Travel Correspondent and must respond by Wednesday, June 25, 2014 at 12:00 p.m. EDT. Non-responsiveness within the prescribed time frame will result in disqualification. TMS is not responsible for the failure for any reason whatsoever of a potential Travel Correspondent to receive notification or for TMS to receive a potential Travel Correspondent’s response.
(iii) before being declared a potential Travel Correspondent, you must sign and return the participant release form (the “Participant Release”) by Friday, June 27, 2014 at 3:00 p.m. EDT. If you do not return the executed Participant Release before the prescribed deadline, you may be disqualified and another potential Travel Correspondent may be selected at the sole discretion of Shaw.
(iv) once confirmed as a Travel Correspondent, you will be provided with the following as part of the Trip:
- round-trip economy airfare leaving from a major Canadian International airport closest to your home, selected by TMS in its sole discretion, (the “Originating Airport”) to Paris, France, and returning to the Originating Airport from Rome, Italy;
- a spot on a Contiki “Best of Europe” tour beginning in Paris, France on and ending in Rome, Italy for approximately two (2) weeks between July 25, 2014 and August 15, 2014;
- twelve (12) nights twin-bed accommodation based on double occupancy, to be shared with another traveler participating in the Best of Europe tour that is of the same sex; and
- twelve (12) continental breakfasts and five (5) three (3) course dinners.
(b) If selected as a Travel Correspondent you:
(i) must be able to participate in the Interviews with TMS;
(ii) must be willing to provide your photos or other audio/visual recording to TMS for use in the Interviews or otherwise;
(iii) must be willing to be filmed while on the Trip for use by TMS and/or Contiki in their sole discretion;
(iv) will be responsible for transportation to and from Originating Airport, travel and medical insurance, travel documentation, airport improvement fees, baggage check fees, taxes, gratuities, telephone calls, in-room charges, meals and beverages that are not included and any other expense not explicitly mentioned in these Audition Guidelines;
(v) may be required to present a valid major credit card upon check-in to cover any expenses over and above the standard room charge;
(vi) will not be permitted to use the following during the Trip unless otherwise instructed (the “Prohibited Technology”): all internet based technology, all cell and mobile based technology, and any GPS enabled device. As a result, you will be responsible for informing friends, family and/or other relevant parties how to communicate with you while on the Trip if necessary;
(vii) will be permitted to use the following: non-digital cameras or any devices provided by TMS or Contiki to you for the purpose of documenting the Trip, as instructed by TMS or Contiki (the “Permitted Technology”); and
(viii) will be required to document the Trip to the best of your ability using the Permitted Technology, unless otherwise instructed.
4. USE OF AUDITION VIDEOS
(a) You retain all right, title and interest (including copyright) in and to the Audition Video you submit to TMS in connection with the Audition.
(b) You hereby grant to Shaw a worldwide, royalty-free, sublicensable, irrevocable, and exclusive license to use, copy, modify, reproduce, display, adapt, promote, exhibit, serve, broadcast, transmit and otherwise exploit in any manner whatsoever your Audition Video in any and all media whether now known or hereafter devised in perpetuity beginning on the date of submission, including, but not limited to, in connection with the administration, promotion and exploitation of the Audition.
(c) Any Audition Videos submitted in connection with the Audition may be posted to public viewing galleries on the Audition Website; such posts may, in TMS’s sole discretion, include your name. By submitting an Audition Video, you agree it may be available for the public to view and TMS will not be held liable for any copying, re-posting or unlawful use of your Audition Video by others that may result. For greater clarity, TMS has no obligation to post your Audition Video on the Audition Website.
(d) You hereby waive any so-called “moral rights” and any right of privacy or personality which you may have in and to the Audition Video in any and all forms of media whether now known or hereafter devised with no further consideration payable to you.
(e) TMS, Shaw and Contiki assume no responsibility for any claims of infringement of rights to intellectual property, privacy and/or personality, related to your Audition Video or your participation in the Audition.
5. PRIVACY / USE OF PERSONAL INFORMATION.
(a) By submitting an Audition Video you: (i) grant to Shaw and TMS the right to use your name, mailing address, telephone number, and e-mail address and Audition Video (collectively the “Personal Information”) for the purpose of administering the Audition, including but not limited to contacting and announcing the Travel Correspondents;(ii) grant to Shaw and TMS the right to use your Personal Information for publicity and promotional purposes relating to the Audition, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledge that Shaw and TMS may disclose your Personal Information to third-party agents and service providers of Shaw and TMS in connection with any of the activities listed in (i) and (ii)above.
(b) Shaw and/or TMS will use your Personal Information only for identified purposes, and protect your Personal Information in a manner that is consistent with Shaw’s Privacy Policy at: www.shawmedia.ca/privacy.asp.
6. TERMINATION. TMS reserves the right, in its sole discretion, to terminate the Audition, in whole or in part, and/or modify, amend or suspend the Audition, and/or the Auditions Guidelines in any way, at any time, for any reason without prior notice.
7. SOCIAL MEDIA. This Audition is in no way sponsored, endorsed, administered or associated with any social media platforms on which the Audition may have been promoted and/or publicized.
- NO OBLIGATION. TMS has no obligation to produce, use or release any aspect of: (i) the Interviews; (ii) the Travel Correspondents photos, recordings or other audio/visual content; and/or (iii) any footage or photos taken by Contiki or TMS representatives on the Trip including the Travel Correspondents or otherwise, (collectively the “Materials”). For greater clarity, TMS is not obligated to have you appear on TMS, and shall have the right at any and all times and in its sole discretion to remove or replace you as a Travel Correspondent for any reason or no reason. Even if you are selected as a Travel Correspondent and participate in the Interviews, the Trip or any part thereof, TMS is not obligated to exhibit, broadcast or otherwise use or exploit the Materials or any part thereof. Furthermore, TMS and/or Shaw may exhibit the Material or any portion thereof, as determined in their sole discretion. You understand and agree that the total amount of air time, if any, featuring or including you as a Travel Correspondentshall be determined by TMS in its sole discretion.
