Edmonton – RCMP Constable Chad McRae has been charged with one count of Common Assault.
The charge stems from an incident in Cold Lake on September 21, 2012.
Police say three officers were called to a complaint of around 100 intoxicated people at a party.
According to RCMP, one of the party-goers, Richard Claybert, was very aggressive and it appeared he wanted to fight officers.
RCMP says officers first pepper sprayed and used a baton on Claybert. Once the spray began to take effect, officers attempted to handcuff Claybert, but they said he continued to be aggressive.
Video was uploaded to YouTube which shows Claybert being kicked in his face by an officer while he is lying on the ground.
Claybert is hearing impaired. RCMP has said officers weren’t aware of that until after the incident.
Following the incident, Claybert was advised by a lawyer not to share details with the media about what had happened.
Constable McRae remains on full duty.
He will make his first court appearance in Cold Lake Provincial Court on January 8, 2014.
