She was rushed to hospital Tuesday morning. She succumbed to her injuries Friday afternoon.

The girl has not been identified.

Police are investigating. As per protocol, police have to investigate the death of any child under the age of five. York Police are seeking any witnesses who may have been in or around the pool on Tuesday.  Police also tried to assure parents that their investigators are “specially-trained” to interview young children regarding sensitive issues.

Documents obtained by Global News show that Pavilion Sports was found to not be in compliance with several safety regulations during city-mandated checks in August and December 2012 including failing to “ensure the minimum number of qualified lifeguards and assistant lifeguards are on duty.”

A more recent check on June 11, 2013 however did not show similar concerns.
