The family’s claim is that at the time of the drowning, the city failed to ensure an appropriate number of lifeguards were on duty.

In a statement, City Solicitor Patricia Warwick said the city is reviewing the claim and will proceed with the normal course of action.

The city will defend the action in court and out of respect for Ali’s family will not be offering any further details.

A provincial coroner’s report in March ruled the death to be accidental.
