Lavallee could face 10 years for role in death of Regina teenager

A Regina man could face up to ten years in jail for manslaughter for his role in the death of 16-year-old Delano Toto in May 2011.  

Bobby Lavallee appeared in court Friday for sentencing submissions, and will face sentencing on November 9. Earlier this month Lavallee pleaded guilty for his role in the homicide of Toto who was found beaten to death near Rae Street and 8th Avenue.

The Crown said 10 years is appropriate because Lavallee has a lengthy criminal record for numerous assault charges, Toto was intoxicated and vulnerable at the time and the attack was pre-planned. 

Lavallee’s defence lawyer is hoping for less time because he showed remorse and was less involved than his two co-accused. Charleton Jonathan Rope and Terry Shawn Smoke will also be sentenced on November 9.  

The court heard Lavallee was part of a gang that got into a fight with a group of people on May 7, 2011. Later in the evening, the three men went to the home where the other group was, and attacked the next person to come out, which happened to be Toto. He was attacked with makeshift weapons and a hammer, and then kicked.

Police driving around the area located his body later that morning.
