Manitoba human rights case for transgender girl cancelled, resolution met

WINNIPEG — A landmark human rights case, involving a nine-year-old transgender girl from Winnipeg, has been cancelled after a voluntary resolution.

Isabella Burgos’ story spread across the country in 2014, when a school in Transcona told Burgos she couldn’t use the girls’ bathroom, even though she identified as a girl.

Burgos’ parents filed a complaint against the River East Transcona School division for discrimination, which was supposed to be heard by the Manitoba Human Rights Commission this summer.

“Ms. Burgos’s complaint was scheduled to be heard before an independent human rights adjudicator,” said the River East Transcona School Division in a media release sent Friday.

“However, as the parties have reached a resolution, the hearing has been cancelled. The parties have agreed to keep the details of the settlement confidential.”

Since the complaint, the Burgos family has moved to Nanamio B.C.

The school division published ‘Gender Identity Guidelines’ in 2015, which have since been revised to “provide greater clarity and emphasis on the rights of transgender students and employees.”
