A convicted murderer is set to receive a new trial for a 2004 killing in Saskatoon. In 2014, Neil Yakimchuk was sentenced to life for killing Isho Hana as part of a drug turf war.

However, on Wednesday in a Regina appeal courtroom the defence and Crown agreed the trial judge made an error during proceedings.

Crown prosecutor Dean Sinclair told Global News the judge failed to offer manslaughter as a choice to the jury.

He says the Saskatchewan Court of Appeal order calls for a new first-degree murder trial. The date for the trial has not been decided.

Three other men, allegedly connected to the murder, are also currently on trial.

Yakimchuk is also serving a second life sentence for a separate murder of a Calgary man.
