A judge acquits Villanueva ruling police violated his rights

Dany Villanueva, the Honduran man charged with armed robbery, has been acquitted because a judge ruled police violated his rights.

Judge Louise Bourdeau acquitted Villanueva of armed robbery and possession of a fake gun because she ruled the police failed to advise Villanueva of his right to a lawyer.

The defence had argued that evidence against Dany Villanueva and his four co-accused should be thrown out on the grounds Montreal police stopped their car because of the colour of the occupants’ skin.

Villanueva was facing deportation to Honduras based on the charges. His immigration lawyer says he will relay Bourdeau’s decision to the Federal Court, which has been asked to review the deportation order.
