Online shoppers protected from late deliveries

CALGARY- Anxiously waiting for those Christmas gifts you ordered online to arrive? If it’s been more than a month and you just can’t wait any longer, it turns out you’re covered.

Calgary’s Merlene Etty bought a Playstation 4 online from Sears, when they went on sale on November 15. Despite a confirmation number, she still hasn’t received it three weeks later—a problem, since many stores are sold out and she needs it in time for Christmas.

“They’re saying they have a record of my order, but they have no idea where it went, that it just got misplaced somehow,” Etty says. “I don’t want to cancel. That’s the big thing on my son’s list and I don’t want to cancel.”

Alberta has a consumer law to protect internet shoppers whose items aren’t delivered within 30 days. Shoppers can legally cancel the order and get a refund, under the internet sales contract regulation.

“The initial business is required to provide you with a refund within 15 days of you providing cancellation,” explains Mike Berezowsky from Service Alberta, adding that there is extra protection for those who pay by credit card. “If you exercise your cancellation rights under our legislation and you are not provided with a refund within 15 days, you can then write to your credit card company and they are required to provide you with the refund.”
