WINNIPEG – The man convicted in the 2005 killing of Phil Haiart in Winnipeg’s West End has been sentenced to 15 years in prison before being eligible for parole.
Jeffrey Cansanay was convicted of second-degree murder in April, a crime that has a minimum sentence of life imprisonment with no eligibility of parole for 10 years.
The Crown pushed that Cansanay not be eligible for parole for at least 25 years, which is the most severe sentence in the Criminal Code, and generally handed down in cases of first-degree murder.
Justice Shawn Greenburg said Thursday that because Cansanay did not intent to kill Haiart, he would not receive the harsher sentence, despite the fact he showed little remorse and was a low chance of being rehabilitated.
Haiart was killed in October 2005 while walking in Winnipeg’s West End. Cansanay was engaged in a gunfight with rival gang members, when a bullet struck Haiart in the stomach. He died in hospital hours later.
