Only one new recommendation has come out of a public inquiry into the drowning death five-year-old southern Alberta boy in 2010.
Maddox James Yellow Wings of Brocket was found unresponsive at Ramada Inn waterpark on September 6, 2010, where he had been swimming during a family member’s birthday party.
A public fatality inquiry from December 13-19, 2012 sought to determine if anything could be done to avoid a similar tragedy in the future.

In a report to the Minister of Justice and Attorney General, Judge Gregory S. Maxwell recommended an independent safety audit for all swimming pools governed by the Alberta Public Health Act.
The safety audit would be conducted prior to commencement of operations, to be reviewed on at least a bi-annual basis.
This recommendation would cover facilities with the definition of Swimming Pool, Wading Pool and Water Spray Park Regulation under the Public Health Act.
Yellow Wings was pulled from the pool by two lifeguards after being seen unresponsive by his grandmother, but paramedics were unable to revive the boy.
An Aquatic Safety Audit followed the death, with recommendations including changes to lifeguard positioning, ratio of lifeguards to swimmers, and elimination of the pool’s waterfall, as it obscured visibility.
