OFFICIAL CONTEST RULES: “Year of Science 2010 Contest”

IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS ("OFFICIAL RULES") BEFORE PARTICIPATING IN THE “YEAR OF SCIENCE CONTEST” (THE “CONTEST”) ORGANIZED BY HER MAJESTY THE QUEEN IN RIGHT OF THE PROVINCE OF BRITISH COLUMBIA, AS REPRESENTED BY THE MINISTER OF ADVANCED EDUCATION AND LABOUR MARKET DEVELOPMENT (THE “PROVINCE”). BY CLICKING THE TERMS AND CONDITIONS ACCEPTANCE BOX AND PARTICIPATING IN THIS CONTEST, YOU REPRESENT THAT YOU SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS IN SECTIONS 2 AND 3 BELOW AND YOU ARE DEEMED TO HAVE READ AND TO HAVE AGREED TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES.

THIS CONTEST WILL BE CONSTRUED AND EVALUATED ACCORDING TO THE LAWS OF BRITISH COLUMBIA AND THE LAWS OF CANADA APPLICABLE TO THE CONTEST. PARTICIPATION IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL RULES.

1. CONTEST OVERVIEW:

1.1 Each entry to the Contest must consist of a video containing your child’s or legal ward’s (“the Child”) idea for a science experiment to be conducted by British Columbia scientists (the “Entry”). The Entry must not (a) contain more than one Child and (b) be longer than ? minutes in length.

1.2 The Contest consists of the following two phases:

(a) The first phase begins at 1:00 p.m. PST, November 1, 2010 and closes at 11:59 p.m. PST April 15, 2011 (the “Submission Period”). During the Submission Period, individuals may submit one or more online Entries. Each individual for which at least one Entry has been submitted during the Submission Period will be eligible to win prizes, as further described below.

(b) The second phase begins at 6:00 p.m. PST, November 15, 2010 and closes at 11:59 p.m. PST May 31, 2011 (the “Panel Judging Period”). During the Panel Judging Period, a panel made up of three members of British Columbia’s science community (the “Judging Panel”) will view the Entries submitted during the Submission Period and will choose:

i. one winner each month for the months of November 2010 to May 2011 inclusive, excluding December 2010 (the “Monthly Prize Winners”); and

ii. from the Monthly Prize Winners, one grand prize winner (the “Grand Prize Winner”) on or before June 30, 2011.

Only those Entries received during the Submission Period will be considered by the Judging Panel. The Monthly Prize Winners and Grand Prize Winners will be awarded prizes as further described in sections 6 below. The Submission Period and the Panel Judging Period are collectively referred to as the “Contest Period”.

2. HOW TO PARTICIPATE: NO PURCHASE NECESSARY.

2.1 During the Submission Period, individuals may submit one or more Entries online at http://www.youtube.com/yearofsciencebc (the “Website”). Entries submitted in any other manner will not be accepted. All individuals for which at least one Entry has been submitted during the Submission Period will be automatically entered in the Contest. Before submitting an Entry, you are required to: (a) read these Official Rules and the YouTube Rules (defined in section 4.2); and (b) check the terms and conditions acceptance box to indicate your acceptance of these Official Rules.

2.2 In the event of a dispute as to the identity of the individual who submitted a specific Entry individuals may be required to provide the Province with proof that he or she is the holder of the YouTube account used to submit the Entry.

3. ELIGIBILITY:

3.1 To be eligible to participate in the Contest by submitting an Entry you must:

a) be a resident of British Columbia;

b) be 19 years of age or older as of November 1, 2010;

c) have a YouTube account; and

d) be the parent or legal guardian of the Child who appears in your Entry.

3.2 You are not eligible to participate in the Contest by submitting an Entry if you are: (a) an employee of the Province, A.S.T.C. Science World Society, Vancouver Aquarium Marine Science Centre, or the Science Fair Foundation of British Columbia; or (b) a member of the immediate family (defined as mother, father, brothers, sisters, sons, daughters and husband or wife, regardless of where they reside) or household of an employee of the Province, A.S.T.C. Science World Society, Vancouver Aquarium Marine Science Centre, or the Science Fair Foundation of British Columbia. At any time, the Province will have the right to require, from any individual participating in this Contest by submitting an Entry, proof of identity and/or eligibility to participate. Failure to provide proof within a reasonable time could result in the removal of the Entry from the Website. All personal and other information requested by and supplied to the Province for the purpose of submitting an Entry to this Contest must be truthful, complete, accurate and in no way misleading.

3.3 The Province, in its sole discretion, reserves the right to remove any Entry from the Website should any individual submitting an Entry to this Contest at any stage supply untruthful, incomplete, inaccurate or misleading information and/or personal information.

4. TERMS OF USE FOR ENTRIES:

4.1 The Province reserves the right to review each Entry submitted to the Website, and to refuse to display on the Website, and to delete from the Website, any Entry that the Province deems, in its sole discretion, to be objectionable or inappropriate, including without limitation any Entry that: (a) is obscene; (b) threatens or is hateful towards a specific group of people; (c) is unlawful; (d) promotes private interests; (e) impersonates or falsely claims to represent a person or organization; or (f) invades the privacy of any person or otherwise violates the rights of any person.

4.2 Your Entry must abide by YouTube’s Terms of Service and/or Community Guidelines (the “YouTube Rules”).

4.3 The Province reserves the right in its sole discretion to remove from the Website at any time any Entry that potentially or actually infringes any third party’s copyright, trade-mark, right of privacy, publicity or other intellectual property or other right.

4.4 You retain ownership of all original content included in or with your Entry on the Website (the “Content”). By submitting an Entry to the Website, and in consideration of the chance for your to win the prizes described below and of the sum of One Dollar and other valuable consideration (the receipt and sufficiency of which you hereby acknowledge), you grant to the Province a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, perform, publish, communicate to the public by telecommunication, modify, display, and distribute the Content in any and all formats, in any and all media, for any and all purposes associated with the Contest.

4.5 You agree that the Province may reformat, rearrange or otherwise modify the Content, and that the Province has no obligation to acknowledge you by name or pseudonym as the author of the Content or to ensure that you remain anonymous.

4.6 You agree that the Province may engage independent contractors and service providers to assist the Province to exercise the rights you grant to the Province under these Official Rules.

4.7 You represent and warrant that: (a) all Content that you submit to the Website is either your original work or has been provided to you or obtained by you from the rightful owner with all necessary permissions; (b) such Content does not infringe upon the copyrights, trade-marks, rights of privacy, publicity or other intellectual property rights of any person or entity; and (c) you have obtained, prior to submitting the Entry, any necessary releases and consents, including without limitation consent in the form available at: http://yearofsciencebc.ca/assets/Documents/Consent.pdf.

to the collection and disclosure of personal information from each identifiable individual whose personal information (including image) appears in the Entry and releases from each identifiable individual whose image appears in the Entry.

4.8 You agree, at the request of the Province, to provide to the Province the releases and consents described in section 4.7 above.

4.9 You agree that under no circumstances will the Province or any of its respective servants, employees or agents be liable to any person or entity for any direct, indirect, special, incidental, consequential or other damages based on: (a) use of any Content pursuant to these Official Rules or the YouTube Rules; (b) any use by you of the Website or any other website to which the Website is linked; or (c) any failure by you to abide by these Official Rules or the YouTube Rules.

4.10 You agree to indemnify, defend and hold harmless the Province and all of its respective servants, employees, contractors and agents from and against all claims, demands, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable legal fees) arising from: (a) your use of the Website or any other website to which the Website is linked; (b) your violation of any provision of these Official Rules or the You Tube Rules; (c) your violation of any third party right, including without limitation any claims or actions based on infringement or violation of intellectual property rights, libel or slander or other defamation, rights of privacy or rights of publicity; and (d) any claim that any Entry submitted by you caused damage to a third party.

4.11 You agree, at the request of the Province, to sign a written acknowledgment of your acceptance of these Official Rules and the YouTube Rules, including but not limited to the terms of use set out in this section 4.

5. PRIVACY:

5.1 By participating in this Contest you consent to: (a) the collection, directly or indirectly, of your personal information and the personal information of the Child (including but not limited to screen name or alias, age, images and contact information) (the “Personal Information”) by the Province for the purposes of administering the Contest; (b) the use and public disclosure of, and access in or outside of Canada to, the Personal Information for any and all purposes in connection with participation in and promotion of the Contest; and (c) the continued use of your email address for future Province contests. The Personal Information is collected pursuant to s. 26(c) of the Freedom of Information and Protection of Privacy Act (British Columbia) and all questions regarding the collection, use and disclosure of the Personal Information may be directed to: Director, Year of Science, 2nd Floor – 835 Humboldt Street, Victoria BC V8W 9T6; Telephone: (250)387-0890. The Personal Information will not be provided to any third parties, other than as provided in these Official Rules and the YouTube Rules.

6. PRIZES:

6.1 Each Monthly Prize Winner will receive a variety of science-related prizes, such as science kits, books, etc. valued at approximately $250. The Monthly Prize Winners may also be awarded activity-related prizes, such as visits to science facilities or the Monthly Prize Winner’s Child’s participation in science experiments. The specific prizes awarded to Monthly Prize Winners will be determined by the Province in its sole discretion.

6.2 Subject to section 6.3 the Grand Prize Winner will receive a scholarship valued at $25,000 (the “Scholarship”), for the benefit of the Child.

6.3 You expressly acknowledge and agree that the Scholarship will be issued to the Child directly when the Child can prove he or she is enrolled in a public post-secondary institution (defined in section 6.4) in British Columbia.

6.4 A public post-secondary institution is a publicly funded college, university or institute, but does not include a private institution or a theological institution.

6.5 All incidental costs and expenses not specifically referred to in these Official Rules (e.g., travel and meals) are not included and are the sole responsibility of the individual receiving the applicable prize.

6.6 Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash. The Province reserves the right, in its sole discretion, to substitute any and all of the prizes of equal value if a prize cannot be awarded as described. The Province will not be responsible, however, if factors beyond the Province’s reasonable control prevent prizes from being fulfilled. Prizes will only be delivered to the verified winning individual.

6.7 The Province reserves the right not to award prizes, or to award only some of the prizes, if there is not a sufficient number of individuals for which at least one Entry has been received to distribute all of the prizes, or if, for any other reason, there is not a sufficient number of individuals to which the prizes can be distributed.

7. AWARDING OF PRIZES:

7.1 Individuals selected by the Judging Panel will be notified by via YouTube message and/or YouTube email (the “Notification”). In the Notification, the Province will request: (a) that the individual provide his or her phone number and email address as well as his or her, and the Child’s full legal name, address, and birth date; and (b) confirmation that the individual wishes to accept a prize from the Contest. An acceptance email or phone call reply, providing the requested information, must be made to the Province by the individual within 48 hours of such Notification. If an individual does not respond in accordance with these Official Rules or is otherwise unwilling or unable to comply with these Official Rules, the individual will be disqualified and another individual may be selected. If an individual responds to the Province within 48 hours from receiving Notification, the Province will contact the individual and will administer, by phone, a skill-testing, time limited mathematical question [(3×3) + (4×4)] in order for the individual to become a winner and to receive a prize. If the individual answers the mathematical question correctly, the individual will be declared a winner provided that the individual complies with the requirements of section 8. Upon answering the mathematical question correctly, the individual will be advised of prize delivery method. Prizes may be delivered via mail or courier, or may be picked up by the individual, and are subject to the discretion of the Province and to the Province receiving the Release (defined in section 8.1) prior to awarding the winning prizes. The Province is not responsible for the failure for any reason whatsoever of any individual to receive Notification or for the Province to receive an individual’s response. Odds of winning will depend on the total number of individuals for which at least one Entry has been submitted during the Submission Period.

8. RELEASE:

8.1 In order to be declared a winner, each individual notified of his or her selection as a winner will be required to execute a legal agreement and release (the “Release”) indicating that the individual: (a) has the necessary legal capacity to enter into the Release; (b) will keep the notification confidential until the official public announcement has been made and the Province informs the individual in writing that the he or she may disclose the notification; (c) agrees to comply with these Official Rules and the YouTube Rules; (d) accepts the winning prize(s) as offered; (e) releases each of the Province, its servants, agents, employees, contractors, licensees, and assignees (the “Released Parties”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, or the acceptance, possession, use, or misuse of any prize, including without limitation, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (f) will obtain and provide to the Province all releases and permissions necessary to grant the Province the unrestricted right to publish without any further compensation the name, photograph, portrait, likeness, audio-video recording, interview, voice and any website dissemination or broadcast thereof of the individual and the Child for the purposes of advertising and promoting the Contest and awarding or publishing the winning prize(s). The Release document may contain such other terms and conditions as the Province, at its sole discretion, may decide. The Release document must be returned by the date indicated on the document or the winning prize(s) will be forfeited.

8.2 By participating in the Contest, each participating individual hereby releases the Released Parties from any and all liability whatsoever, and waives any and all causes of action, related to any injuries, loss or damage of any kind to any person or persons (including, without limitation, death or personal injury, property damage, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) resulting in whole or in part, directly or indirectly, from participation in the Contest.

9. LIMITATION OF LIABILITY:

9.1 Under no circumstances will the Province be liable to any person or business entity for any direct, indirect, special, incidental, consequential, or other damages based on any use of the Website or any other website to which the Website is linked, including, without limitation, any lost profits, business interruption, or loss of programs or information, even if the Province has been specifically advised of the possibility of such damages. The Province assumes no responsibility for failure of the Internet or the Website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the Internet or at any website, or any combination thereof or other failures related to hardware, software or virus, or incomplete, illegible, lost, late or misdirected Entries. The Province reserves the right, in its sole discretion, to cancel or suspend this Contest if a virus, bug or other cause beyond its reasonable control corrupts the security or proper administration of the Contest. Any attempt to deliberately damage the Website or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. If such an attempt be made, the Province reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

10. MISCELLANEOUS:

10.1 All decisions of the Province will be final and binding in all matters relating to this Contest. The Province reserves the right, without prior notice, to cancel, terminate or modify the Contest, including these Official Rules, if it cannot be operated, conducted or completed as planned, for any reason. If any term or provision of these Official Rules or the YouTube Rules are invalid, illegal or unenforceable, all other terms and provisions will nonetheless remain in full force and effect.

10.2 YouTube is a registered trade-mark of Google Inc. and is not a sponsor of this Contest nor is it affiliated with this Contest in any way.

11. LAWS:

11.1 This Contest is subject to federal, provincial and municipal laws and regulations. These Official Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws.

12. WARRANTY DISCLAIMER:

The Website and all of the information related to this contest is provided "as is" without warranty of any kind, whether express or implied. All implied warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement, are hereby expressly disclaimed. All prizes are awarded "as is" and without warranty of any kind, express or implied.

13. COPYRIGHT NOTICE:

13.1 Subject to section 14.2, the Contest and all accompanying materials have for copyright ©2010 Province of British Columbia. All rights reserved.

13.2 With the exception of the Content and any material on the Website owned by third parties, all intellectual property and all of the promotional materials are owned by the Province. The Website and source codes to the Website are owned by YouTube. Copying or unauthorized use of any copyrighted material or official marks or trade-marks without the express written consent of the Province is strictly prohibited.
