An Alberta man accused of impaired driving causing death in a fatal North Battleford, Sask. crash will not be going on trial.

Charges were stayed Tuesday against Harold Weiss, 64, in a North Battleford courtroom.

Weiss, who is from Barrhead, Alta., was charged after a semi truck slammed into an SUV at the intersection of Highway 40 and Highway 16 in late February in North Battleford.

The semi drove through the centre guardrail into oncoming traffic, hitting the SUV stopped at a red light, killing the driver instantly.

Crown prosecutor Tanner Daniels said results of Weiss’s toxicology report indicated there weren’t any drugs in his system at the time of the crash.

Daniels also said there was insufficient evidence to suggest Weiss drove dangerously and medical distress couldn’t be ruled out as a factor in the crash.
